Chapter 1 General Provisions

Article 1: In order to ensure public safety, regulate postal and logistics safety activities, and achieve the overall goal of social stability and long-term peace, this regulation is formulated in accordance with relevant laws and regulations and in combination with the actual situation of this city.

Article 2: The term 'delivery logistics safety' referred to in these Regulations refers to the state in which delivery logistics operators fulfill their public safety obligations in the processes of receiving, sorting, transporting, and delivering goods.

Article 3: This regulation applies to the safety management of postal logistics activities within the administrative area of this city, as well as the standardization and development of the postal logistics industry.

Article 4: The safety management of postal and delivery logistics shall adhere to the principles of safety first, prevention oriented, and comprehensive governance, and establish mechanisms for enterprise responsibility, government supervision, industry self-discipline, and social supervision.

Article 5: The municipal and district (county) people's governments shall incorporate the safety management of postal and delivery logistics into the national economic and social development plan, and coordinate the development of the postal and delivery logistics industry.

Article 6: City and district (county) postal logistics management agencies are responsible for the unified supervision and management of postal logistics safety in their respective administrative regions


(1) Implement relevant laws, regulations, guidelines, and policies;

(2) Responsible for the management, guidance, coordination, and supervision of the delivery logistics industry;

(3) Develop and implement the overall plan and safety special plan for delivery logistics within this administrative region;

(4) Develop and implement safety management systems and measures for delivery logistics;

(5) Organize and carry out the popularization, publicity and education of safety management knowledge in postal and delivery logistics;

(6) Organize and coordinate relevant departments to carry out joint law enforcement and illegal rectification work in the postal logistics industry, and investigate and punish illegal activities in postal logistics activities in accordance with the law;

(7) Coordinate the investment promotion work of major delivery logistics projects and promote the construction of major delivery logistics projects;

(8) Encourage and support the use of new energy vehicles in logistics delivery activities, and vigorously promote cost reduction and efficiency improvement in the logistics delivery industry;

(9) Establish a delivery logistics security management information system, responsible for promoting technological progress, standardization, and informatization in the delivery logistics industry;

(10) Accepting social complaints and mediating industry disputes;

(11) Other matters stipulated by laws and regulations.

Article 7 The postal management department is responsible for supervising and managing the postal market and express delivery market.

The transportation authorities and road transportation management agencies shall supervise and inspect road transportation and related business activities in accordance with the law.

The public security organs are responsible for guiding, inspecting, and supervising the implementation of internal security measures by postal logistics operators, establishing and improving public security management systems, and lawfully investigating and punishing illegal and criminal activities carried out through postal logistics activities.

The Comprehensive Management Office, National Security, Economy and Information Technology, Industry and Commerce, Commerce, Safety Supervision, Quality Supervision, Customs, Railway, Civil Aviation and other relevant departments shall, in accordance with their respective functions, do a good job in the safety management of postal and delivery logistics in accordance with the law.

Article 8: The Postal and Delivery Logistics Industry Association shall strengthen industry self-discipline, provide information, training and other services to member enterprises, and cooperate with relevant departments to do a good job in safety management.

Chapter 2 Delivery Logistics Security Management

Article 9: This city shall establish a cross departmental, cross disciplinary, and cross regional mechanism for the safety management of postal logistics, involving administrative management departments, public security organs, and postal logistics operators, to create a safe and beneficial atmosphere for stable development.

Article 10: After obtaining the business license, the delivery logistics operator shall report in writing to the delivery logistics management agency within 15 days.

If there is a change in the name, business premises, and other relevant information of the delivery logistics operator, the delivery logistics operator shall report in writing to the delivery logistics management agency within 15 days with the updated business license issued by the industry and commerce department.

Article 11: The legal representative or main person in charge of a postal logistics operator shall be the first person responsible for postal logistics safety and shall perform the following duties:

(1) Establish and improve the safety management system for delivery logistics, organize the formulation and implementation of delivery logistics safety regulations and operating procedures;

(2) Establish a retention system and traceability system for shippers, carriers, consignees, consigned items, and related information;

(3) Establish a system for signing security assurance agreements with contracted clients;

(4) Establish a delivery logistics safety management organization or appoint full-time (part-time) safety management personnel;

(5) Equip delivery logistics with secure physical and technical defense facilities to ensure investment in safety production funds;

(6) Organize the development and implementation of the enterprise's delivery logistics safety education and training plan;

(7) Supervise and inspect the safety of delivery logistics, and promptly eliminate potential safety hazards;

(8) Organize the development and implementation of emergency plans for delivery logistics safety accidents, and conduct regular drills;

(9) Fulfill the obligation to maintain social stability and promptly and truthfully report any potential safety hazards and accidents in the delivery logistics to the delivery logistics management agency;

(10) Other responsibilities stipulated by laws and regulations.

Article 12: When sending or receiving items, the relevant regulations of the state and autonomous region prohibiting or restricting the delivery and transportation shall be followed, and the information of the sent or received items shall be truthfully filled in.

Article 13: Postal and delivery logistics operators shall install video surveillance equipment at various stages such as receiving, sorting, transportation, delivery, and security checks, as well as at road freight transportation receiving locations, and connect it to the postal and delivery logistics management agencies and public security information platforms.

The monitoring system should operate 24 hours a day, and the storage time of monitoring data should not be less than 90 days.

Article 14: Postal and delivery logistics operators shall prominently publicize the list of prohibited and restricted postal items, the inspection system for receiving and sending, the real name registration system, the safety operation procedures, the machine security inspection system, the emergency response regulations for sudden incidents, and safety signs at their business outlets, processing centers, and distribution centers.

Article 15: When receiving goods, the delivery logistics operator shall check the security information, verify the sender's valid identity documents, and register according to the requirements of real name registration. The retention period of registration records shall not be less than eighteen months.

For enterprise customers who have already signed a security agreement, the delivery logistics operator shall register the valid identity information of the enterprise leader and the main daily delivery personnel. Those who have already been registered should have their customer identity information reviewed regularly.

Delivery logistics operators shall implement customer identity verification systems through information technology in accordance with the requirements of relevant departments.

Article 16: Delivery logistics operators shall establish a system for inspecting the receipt and transportation of goods. Except in special circumstances, items entering this city, including transit items, should undergo non-invasive inspection or unsealed inspection and security checks, and be marked with verification, inspection or inspection marks.

The delivery logistics operator shall inspect the contents of the received and transported items (excluding letters); Unable to determine the safety of the item, the sender should be required to provide a safety certificate from the relevant department; If the sender cannot provide a safety certificate and refuses to inspect, the package will not be accepted for transportation.

Article 17: Postal logistics operators shall be equipped with safety inspection equipment that meets national standards and has perspective detection functions, and arrange personnel with corresponding knowledge and skills to conduct safety inspections on postal items in accordance with regulations.

Article 18: Postal and delivery logistics operators shall ensure the safety of goods during the processes of receiving, sorting, transportation, and delivery. If prohibited items are found, they shall immediately report to the postal and delivery logistics management agency and public security organs, and handle them in accordance with relevant regulations.

Article 19: Postal and delivery logistics operators shall establish employee files, review the proposed employees, and the public security organs shall cooperate in relevant work.

Delivery logistics operators should regularly provide delivery logistics safety training to their employees and establish training records.

Article 20: If a user who signs a security guarantee agreement falls under any of the following circumstances, they may conduct security inspections through sampling, spot checks, or other methods, and register properly:

(1) Goods with special requirements for existing packaging or other objective reasons that cannot be unpacked for inspection;

(2) The volume of the goods is too large to undergo non-invasive inspection and security checks.

Article 21: Delivery logistics operators shall establish a file management system for receiving and transporting consignment notes and related electronic information. Unless otherwise stipulated by laws and administrative regulations, the retention period of information records shall not be less than 18 months. After the expiration of the storage period, it should be destroyed in accordance with relevant regulations, and a record of the destruction should be kept. It is not allowed to dispose of it at will.

Chapter 3 Supervision and Management

Article 22: Postal and delivery logistics management agencies shall regularly supervise and inspect the implementation of real name collection and delivery, collection and delivery inspection, machine security inspection system, and public security prevention measures by postal and delivery logistics operators.

Article 23: Delivery logistics management institutions shall establish a directory of delivery logistics operators and evaluate the safety level of delivery logistics operators according to the prescribed standards.

The safety management level standards are formulated by the postal logistics management agency in conjunction with the transportation management department, road transportation management agency, postal management department, public security organs and other relevant departments.

Article 24: The delivery logistics management agency shall establish a list of delivery logistics operators with safety abnormalities, and include delivery logistics operators who fail the safety rating in the list of delivery logistics operation safety abnormalities, and publish it to the public through news media or industry websites.

Article 25: Postal and delivery logistics management institutions shall regularly organize joint meetings to exchange information, coordinate and coordinate the safety management of postal and delivery logistics.

Article 26: Any unit or individual has the right to report acts that violate the safety management of postal and delivery logistics, and the municipal and district (county) people's governments shall give rewards or commendations.

Chapter 4 Legal Liability

Article 27: If a delivery logistics operator falls under any of the following circumstances, the delivery logistics management agency shall order it to make corrections within a specified period of time; For those who fail to make corrections within the prescribed time, a fine of not less than 2000 yuan but not more than 10000 yuan shall be imposed:

(1) Failure to prominently display the list of prohibited and restricted items, inspection system for receiving and sending, real name registration system, safety operation procedures, security check system, emergency response regulations and safety signs at business outlets, processing centers and distribution centers;

(2) Failure to install monitoring equipment or failure to rectify damaged monitoring equipment on schedule;

(3) The monitoring equipment has not been running for 24 hours, or the monitoring data has been stored for less than 90 days;

(4) Failure to establish a management system for receiving, shipping consignment notes, and related electronic information files;

(5) Failure to timely report violations of postal logistics safety management to the postal logistics management agency;

(6) Failure to provide delivery logistics safety training to employees and establish training records.

Article 28: If a delivery logistics operator violates the provisions of these Regulations by failing to conduct non-invasive inspection of the received items or failing to implement the delivery inspection system, the delivery logistics management agency shall impose a fine of not less than 100000 yuan but not more than 300000 yuan, and impose a fine of not more than 100000 yuan on the directly responsible person in charge and other directly responsible personnel.

Article 29: If there are already penalty provisions in relevant laws and regulations for violating the provisions of this Regulation, those provisions shall prevail.

Article 30: If the staff of the delivery logistics management agency neglect their duties, abuse their power, engage in favoritism and fraud in their work, they shall be dealt with by the delivery logistics management agency; Those who commit crimes shall be held criminally responsible in accordance with the law.

Article 31: If any of the following situations occur among the relevant competent departments and their staff, the responsible persons shall be held accountable by their respective units or higher-level competent departments in accordance with the law:; If a crime is committed, criminal responsibility shall be pursued in accordance with the law:

(1) The implementation of safety supervision system is not strict, and the foundation of safety supervision for delivery logistics in this jurisdiction is weak, resulting in serious consequences;

(2) Failure to fulfill legal responsibilities to guide and supervise delivery logistics operators to establish and implement safety responsibility systems, as well as systems for receiving and sending inspections, real name receiving and sending, and machine security checks, resulting in serious consequences;

(3) Failure to promptly identify significant safety hazards in the delivery logistics operator, or failure to take timely measures upon discovery, resulting in serious consequences;

(4) Failure to handle illegal activities in the delivery logistics in accordance with the law;

(5) Other circumstances stipulated by laws and regulations.
